Terms of Service

These Terms of Service ("Terms") govern the use of the Bolus Famille application (the "App"), displayed under the iOS icon as "Gabriete", published by Marmites (the "Publisher").

Using the App implies full acceptance of these Terms.

The App is a food tracking tool for families raising a child with type 1 diabetes. It allows:

• logging meals and carb amounts
• recording bolus injections as a journal
• tracking care events (infusion set, sensor, hypoglycemia)
• syncing data across family devices

The App is not a medical device under Regulation (EU) 2017/745. It provides no insulin dosage recommendation, diagnoses no condition, and never replaces a health professional's advice.

The user agrees to consult their care team for any therapeutic decision. The Publisher cannot be held liable for medical decisions made based on data displayed in the App.

Using the App requires creating an account with a valid email address. The user agrees to:

• provide accurate information
• keep their password confidential
• be of age or act as legal representative of a minor

The App is provided free of charge, with no in-app purchase or subscription. The Publisher reserves the right to introduce paid features in the future, in which case users will be notified beforehand and will retain access to current features as they were at the time of the change.

The App, its source code, graphics, brand and name are the exclusive property of Marmites. Reproduction without permission is prohibited.

Data entered by the user remains the user's property. The Publisher acquires no rights beyond what is strictly necessary to operate the service.

Personal data processing is described in the privacy policy. The App complies with the GDPR.

The Publisher makes reasonable efforts to ensure service availability, but cannot guarantee uninterrupted availability. Since the App is designed to work offline, server unavailability does not affect local entry.

To the extent permitted by law, the Publisher cannot be held liable for:

• any medical decision taken by the user based on displayed data
• data loss due to user mishandling
• temporary service unavailability due to force majeure or maintenance

These limitations do not apply in cases of intent or gross negligence by the Publisher, nor do they waive non-waivable consumer rights provided by applicable law.

The user may delete their account at any time from the App. This permanently erases all their data from the Publisher's systems.

The Publisher reserves the right to suspend or delete an account in case of manifest violation of these Terms, with prior notice when possible.

The Publisher reserves the right to amend these Terms at any time. Material changes are notified by email and on next App launch.

These Terms are governed by French law. In case of dispute, after attempting amicable resolution, the courts of the Publisher's registered office shall have jurisdiction, unless mandatory legal provisions state otherwise.
